MAMATA BANERJEE ON ACQUISITION OF LAND FOR INDIAN RAILWAYS IN WEST BENGAL

In the name of saving “agricultural land” and ‘environment’ Mamata Banerjee with the help of Maoists, Naxalites, SUCI, land Sharks and Mafias, real estate promoters hardened criminals, industrial competitors, few perverted, dishonest, self-centered, sycophant, spineless, greedy Communist hater intellectuals, painters, writers, singers, film-actors and media did not allow forcibly coming up of much-awaited Chemical Hub at Nandigram, Tata’s Nano Factory at Singur, expansion of National Highways, construction of Hospitals, I.T. Parks, Bridges, Aerodromes, Industries, Thermal Power Plants, etc. in West Bengal. Now, after becoming the Railway Minister, the same Mamata Banerjee proposes to acquire 35,000 acres of agricultural land for Indian Railways. She has already has started acquiring 320 acres of 2-crop/3-crop valuable prime agricultural land for different types of railway projects in West Bengal. Further 500 acres of land of similar nature is going to be acquired soon for laying of 32 KM railway track from Howrah’s Bodogachia to Hooghly’s Champadanga. The Indian Railways have already started felling of 66, 70,000 valuable trees in the nearby forest at Adra for setting up of a 1000 MW Power Plant under her instruction. All these are nothing but her sheer dishonesty, duplicity, political gimmick and fraudulence on the people for election gains only.

MYSTERIOUS ROLE OF NGOSs AGAINST LEFT FRONT IN WB

In different states of India, there are problems relating to suicides by farmers, SEZ, hunger, land acquisition, drought, industrialization, urbanization, construction of Thermal Power Plants, aerodromes, expansion of Roads and so on. But some suspicious NGOs and their organizers, instead of other states, have concentrated their total destructive activities in WB only against Communist led Left Front Government in the name environment and fighting SEZ in Nandigram, Singur and Lalgarh. The lavish life style of these organizers, their extravagant expenditure on frequent air flights, lodging and boarding at 5 Star Hotels, traveling in fleet of costly cars, their connection with Maoists, other antinational terrorist outfits financed by outside and with some spineless greedy sycophant intellectuals, their proximity and easy access to prejudiced WB Governor are all a matter of serious concern. The mysterious source of their income and mode of expenditure needs a thorough investigation in national interest.

WB GOVERNOR NEGLECTS A WIDOWED MOTHER

On 30-07-2009 two policemen Sabbir Molla and Kanchan Gorai were abducted by Maoists at Lalgarh. It is unknown whether they are alive. Jahanara Begum, aggrieved mother of Sabbir, wanted to meet Shri Gopal Krishna Gandhi, Governor of WB. But he has refused. In past, he also did not condemn murder of Sadhucharan Chatterjee, a police officer, at Nandigram and a doctor, a nurse and another government official on duty at Jangalmahal by TMC-Maoists. The gruesome burning to death of a minor tribal girl Jharna Mandi did not move him at all. But he was traumatized when Khokon Sheet, a dreaded Maoist killer, responsible for ghastly murder of Shankar Samanta and others at Nandigram, was admitted to SSKM Hospital at Kolkata with injury. He himself rushed to see him. Besides, he had visited again and again Mamata Banerjee fasting against ‘Nano’ at Esplanade. Organizers of present unprecedented violence in WB have easy access to him any time but not an aggrieved mother of a poor policeman. Shame!

WB GOVERNOR IS NOT SO INNOCENT AND IMPARTIAL AS HE PRETENDS



Shri Gopal Krishna Gandhi, Governor of West Bengal, is not so innocent as he apparently looks. He is the “Friend, Philosopher and Guide” of the Maoist-TMC-Congress-SUCI Alliance. He makes frequent politically motivated prejudiced public statements aiming at to destabilize the Left Front Government by creating public opinion in favour of the said gang-up instead of discharging impartially and honestly his duties as a constitutional head. His so-called conscience arises on particular occasions to suit the political interests and violence of the disruptive and destructive opposition. The Governor House has become a centre for hatching political conspiracy against the mainstream leftists. It is reported that he conspired with opposition parties and industrial competitors to get ‘Nano’ car factory to Gujarat. He should immediately join TMC or CPI (Maoist) for the sake of neutrality; otherwise the fate of Dharma Veera waits for him.

WB GOVERNOR CONSPIRES AGAINST HIS OWN GOVERNMENT

In Shamsher Singh Vs State of Punjab, the Supreme Court held that the President and the Governors are only constitutional heads and they exercise their power and functions with the aid and advice of the Council of Ministers and not personally. Wherever the constitution requires the ‘satisfaction’ of the President or the Governor, the ‘satisfaction’ is not the personal satisfaction of the President or the Governor but it is the satisfaction of the Council of Ministers. The frequent politically motivated public statements issued by the Governor of West Bengal to embarrass, heckle and humiliate the Left Front Government and tarnish its image, therefore, not only go against the spirit of the Constitution but also aimed at subverting it. His blatant misuse of power and modus operandi for creating constitutional crisis in the state with the help of the opposition has, therefore, considerably and definitely lowered and damaged the dignity, honour, prestige and status of this august office.

WB GOVERNOR AGAINST HIS OWN GOVERNMENT

The Governor is a constitutional head of a state. So, he has two options only. He may call the Chief Minister or any of his Ministers for discussion on any matter which he considers to be serious. The second option is that he may send his report to the Central Government. One eminent Indian Constitutional Expert has very rightly commented that the Governor cannot have any personal view. He has to work within the constitutional limitations. He has no scope for possessing any opinion different from that of the state government. The frequent politically motivated statements issued by the Governor of West Bengal for landing the Left Front Government in trouble should be considered in this perspective only. His one and only aim is to tarnish the image of the state government for encouraging and assisting the TMC, Congress & Maoists. To tell the truth, he himself is trying to create constitutional crisis in the state with the help of the opposition for imposition of President’s rule.

PRO-MAOIST CENTRAL MINISTERS

Dr.Manmoan Singh has again and again declared ‘Maoists” as the greatest threat to internal security of the nation. But his one Cabinet Minister and six Ministers-of-State openly support Maoists, keep close contact with them and hold regular meetings with them. These ministers not only frequently demand withdrawal of joint operation against Maoists but also some of them even visited Lalgarh recently to embolden Maoists to carry out their destructive activities and mass killing of tribals in the name of so-called ‘revolution’. The function of cabinet is a collective responsibility. The role of the UPA Government is, therefore, nothing but dubious, double standard, antinational, treacherous, dishonest and fraudulent. The objective of destabilizing a duly constitutionally elected state government and encouraging terrorist outfits is aimed at to achieve some petty political gains at the cost of the nation.

WB GOVERNOR ACTS AS CHIEF POLITICAL CAMPAIGNER OF MAMATA BANERJEE

The Tollygunge-Garia Extension of Metro Rail in Kolkata costing over Rs.1100 crores is a Joint Venture of Central Government and State Government. It was initiated by State Government in 1998 itself. It has shared above 33% of its cost. Besides, it acquired land and rehabilitated all evicted people. During execution Mamata Banerjee opposed the project vehemently. She inaugurated the project on 22nd August, 2009 without inviting Chief Minister and the Mayor of Kolkata and has named its stations unilaterally. Despite this unprecedented humiliation, the Governor being the Constitutional Head of the state attended the function-converted-into-TMC Political Platform as the Chief Political Campaigner of Mamata Banerjee. All along he praised her but did not utter a single word or issue public statement about contribution of his own government and about its unparalleled dishonor. His sleeping conscience wakes up on special occasions only as and when desired by Mamata Banerjee and Maoists to push their political agenda.

MAMATA BANERJEE'S DUPLICITY ON INDUSTRIALISATION

In anticipation of becoming Chief Minister, Mamata Banerjee, a personification of indiscipline, blatant lies, arrogance and duplicity, now talks about speedy industrialization. It reminds us a Hindi proverb which means “THE CAT HAS SET OUT FOR PILGRIMAGE AFTER EATING THOUSAND RATS”. It is she, who with politically motivated blessings of WB Governor, is solely responsible for abandonment of much-awaited Chemical Hub at Nandigram, Tata’s Nano Factory at Singur, expansion of National Highways, construction of Hospitals, I.T. Parks, Bridges, Aerodromes, Industries, Thermal Power Plants, etc. Her entire agitation and TMC’s election expenditure was financed by industrial competitors and multinational companies. Maoists and NGOs of suspicious character and some spineless greedy sycophant intellectuals are her vanguards. So, her hypocritical tall talk about industrialization is nothing but a deep rooted ill designed maneuver to befool the innocent people again for achieving undue political advantage.

BURN STANDARD COMPANY LIMITED - TRANSFER OF REFRACTORY UNITS TO WB GOVERNMENT

Prior to their closure, the Lalkuthi and Raniganj-II Units of Burn Standard Company Limited, a Company taken over by Central Government in 1973, nationalized in 1976 and placed under the control of Department of Heavy Industry, Government of India were largely catering to the refractory needs of IISCO for the historic reason of both the companies being owned by the same private corporate company before take over and nationalization. Of those, the Lalkuthi Unit for being specialized in manufacturing Silica Coke Oven refractory supplied this particular quality of refractory to all other integrated Steel Plants of the country as well as to the Coke Oven Plants.

Before Nationalization, the Refractory Units at Lalkuthi and Raniganj II along with other five such units were making profit which was confirmed by the then Minister for Industries and Steel on the floor of the Parliament. However after the take over of these units, due to mismanagement it incurred loss and ultimately referred to BIFR in November, 1994 and was declared sick. The department of Heavy Industry, Government of India did not agree to invest required amount of huge money for its revival. Ultimately it was referred to BIFR in November, 1994.

The Refractory units were considered for revival along with the parent company M/s. BSCL by the Hon’ble Bench during a number of sittings. In the final hearing, in spite of strong recommendation from both the Operating Agency and the Consultant to the viability of revival of the Lalkuthi Unit of Raniganj, the owner in the Department of Heavy Industry, Government of India, refused to accept the proposal and the closure of the unit was ordered by the Hon’ble Bench by order dated 16.04.1999. The unit was closed down by M/s. BSCL and all the employees were almost forced to take VRS.

Considering the viability as was brought out by the Consultant and the changed market demand for the product, the Government of West Bengal, on a request from the ex-employees of the company, took up a proposal with the Department of Heavy Industry, Government of India, for revival of the unit and run it as an industrial cooperative of the ex-employees of M/s. BSCL without any financial commitment from the Department of Heavy Industries.

The Hon’ble MIC, PE&IR, Government of West Bengal requested the then Hon’ble Minister of Industry to consider a proposal of permitting utilization of the assets of these two closed BSCL units by nearly 400 strong employees through a cooperative society.

The Director (Personnel), Burns Standard Company Limited vide its letter dated 30-10-2000 to the Chief Promoter of the proposed Co-operative Society conveyed “No Objection” for the purpose of registration of the society.

The Hon’ble Minister, DHI had a very positive attitude in this regard and assured the Hon’ble MIC of West Bengal the following vide his D.O. No. 3(54)/2000-PE-III/349 dated 30-10-2000.

“I have noted your request for permitting a workers cooperative to utilize industrial assets of the Lalkuthi Unit without any financial support. I will be happy to favourably consider such a proposal. You will appreciate that the details of the proposal will have to be worked out before a final decision can be taken in this regard and approval of the competent authority can be obtained”.

Shri Manohar Joshi, the then Hon’ble Minister for Heavy Industry, Government of India in his D.O. No. 3(54)/2000/P-III-263 dated 19-07-2001 addressed to the Minister for Public Enterprises and Industrial Reconstruction, West Bengal assured to on this Unit to the Government of West Bengal on “as is where is basis” who in turn could handle the modalities and pass on the management of Lalkuthi Unit to the Registered Co-operative of the ex-employees. A viable project duly vetted has also been worked out. Based on the acceptance by
the Department of Heavy Industries and “No Objection” by the BSCL a Workers’ Co-operative was duly registered.

Apart from this, on 18-12-2003 in reply to Unstarred Question No. 2394, MOS, HI & PE, GOI stated the following.

“A proposal for handing over the Unit to the Government of West Bengal for subsequent transfer to the Registered workers’ cooperative received from Government of West Bengal is under consideration”

While working out of modalities of transfer of Land and Assets, the Department of Heavy Industries were willing to give the assets at Book Value or less but wanted market price for the land involved. It was then pointed out that the land in question belonged to the State and was only on Lease to BSCL. A joint scrutiny of Land Records was carried out by the Representatives of the Company and the Subdivisional Land & Land Reforms Officer, Asansol. It was jointly agreed that the 84.7 acres of land that is proposed to be transferred belonged to the State and was on lease to BSCL for industrial purposes. Since the land belongs to the State Government the land should automatically revert to the State and the question of payment for the Land does not arise. Nor can the company sell this land to any other party.

The land being the property of the State, the same automatically gets reverted back to the Government of West Bengal. It is willing to give the land involved on a long term lease at a very nominal rent.

It is pertinent to mention that the then MIC, Department of Heavy Industry had stated that in case of a Workers’ Co-operative he was willing to transfer the assets at a token price of Rs. 1/- only.

The Government of West Bengal had also communicated to the Union Government vide its memo dated 06-11-2003 that it was ready to pay demolition/scrap value of the assets (buildings, plants, machineries etc) estimated by an independent valuer.

It is a fact that much time has been wasted in maintaining official procedures and paraphernalia. Any sort of further delay will cause irreparable damage to the chances of reopening and revival of the said units as the plants and machinery are getting rusted and eroded with the passage of each day. Delay in making the unit operational on this or that plea affects the plants and machineries adversely due to prolonged idleness.

With the changed industrial atmosphere in Raniganj-Asansol Area and modernization of IISCO and proposed revival of Lalkuthi Unit of BSCL the demand for product from the R & C Units of Lalkuthi is ever increasing.

All the closed units have been left unsecured and unguarded by the GOI. The separated workers have been guarding the units and its valuable properties round the clock for the last 7 (seven) years without any remuneration in order to save them from loot and plunder in anticipation of revival through cooperative society.

A long period of time has already elapsed in disposing of the matter. Since the question of land and assets has already been finalized, the land with its assets is transferred to the state government by the Union Government in no time without raising any further pretext.
